Terms of Use
1. Who we are and what this covers
Ethos Creative Agency LLC ("Ethos," "we," "us") is a Tennessee-based strategy and creative firm. These Terms of Use govern your access to and use of our website at ethoscreative.agency, including any subdomains.
By visiting or using the site, you agree to these terms. If you don't agree, please don't use the site. If anything here is unclear, email contact@stevenlowry.com and we'll explain it in plain language.
These terms cover the website. They don't cover client engagements — engagements are governed by a separate written agreement between Ethos and the client.
2. Eligibility and acceptable use
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the site.
You agree not to:
- Use the site for any unlawful purpose, or in any way that violates these terms
- Attempt to gain unauthorized access to the site, its servers, or any related systems
- Interfere with or disrupt the site's operation (including by transmitting malware, overloading servers, or probing for vulnerabilities)
- Scrape, harvest, or otherwise programmatically extract content from the site without our written permission
- Use any content from the site to train artificial intelligence or machine learning models without our written permission
- Frame or mirror any part of the site without our written permission
- Impersonate any person or entity, or misrepresent your affiliation with one
- Submit false, misleading, or fraudulent information through any form on the site
We may suspend or terminate your access to the site at any time, with or without notice, for any reason — including suspected violation of these terms.
3. Our content
The site, including its design, text, graphics, images, logos, brand marks, frameworks, methods, and the underlying code, is owned by Ethos or our licensors and is protected by US and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and view the site for your own personal or internal business use. Anything beyond that — copying, redistributing, modifying, republishing, or commercial use of any kind — requires our written permission.
Quoting short excerpts of educational content for commentary or critique with clear attribution is fine. Republishing whole articles, repackaging our frameworks as your own, or using our content in derivative paid products is not.
The "Ethos" and "Ethos Creative Agency" names and related logos are trademarks of Ethos Creative Agency LLC.
4. Your submissions
When you submit information through a form on the site — a Strategy Session request, a contact message, a newsletter signup — you agree that:
- The information you submit is accurate to the best of your knowledge
- You have the right to submit it
- Submitting it doesn't violate anyone else's rights or any law
You retain ownership of what you submit. You grant Ethos a non-exclusive, royalty-free license to use it for the purpose of responding to your inquiry, providing requested services, and our internal business operations. We don't publicly share what you submit unless you've expressly told us to.
How we handle your personal information is covered in the Privacy Policy.
5. Educational content
The blog, Insights, and similar pages publish strategic content for general educational purposes. This content reflects our perspective and experience at the time of writing.
It does not constitute professional, legal, financial, or business advice for your specific situation. Don't act on it without verifying it for your own context, and consider talking to a qualified advisor before making material decisions based on what you read here.
If you want our specific perspective on your business, that's what a Strategy Session is for.
6. Third-party links
The site may link to third-party sites, services, or resources. We don't own or control those, and we're not responsible for their content, privacy practices, or accuracy. Following a third-party link is at your own discretion and risk.
7. Site availability
We work to keep the site available and functional, but we don't guarantee uptime, accuracy, or that the site will be free of errors or interruptions. We may modify, suspend, or discontinue any part of the site at any time without notice.
8. Disclaimers and limitation of liability
Disclaimers. The site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will meet your needs, that it will be uninterrupted or error-free, or that any information on it is accurate, complete, or current.
Limitation of liability. To the fullest extent permitted by law, Ethos and its members, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or related to your use of the site, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or related to your use of the site will not exceed one hundred US dollars ($100).
Some jurisdictions don't allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Termination
We may terminate or suspend your access to the site at any time, with or without notice or cause. On termination, the parts of these terms that by their nature should survive — including those on intellectual property, disclaimers, limitation of liability, and governing law — continue to apply.
10. Governing law and venue
These terms are governed by the laws of the State of Tennessee, without regard to its conflict of law principles. Any dispute arising out of or relating to these terms or your use of the site will be brought exclusively in the state or federal courts located in Maury County, Tennessee, and you consent to the personal jurisdiction of those courts.
11. Changes to these terms
We may update these terms from time to time. When we do, we'll change the date at the top of the page. Material changes will be flagged where appropriate. Continuing to use the site after the changes take effect means you accept the updated terms.
12. Miscellaneous
If any part of these terms is found to be unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of our right to do so later. These terms, along with the Privacy Policy and any other written agreements you have with Ethos, are the entire agreement between you and Ethos regarding the site.
